Study PermitAlthough Canada is a land of opportunities, especially for younger generations due to the vast opportunity for education, an international student may still be required to obtain a study permit if studies are to occur in Canada.

It is important to note that a study permit may not be enough to come to Canada. A study permit is in place to allow an international student to obtain an education once in Canada, if the student is from a visa requiring country, he or she will still be required to obtain a Temporary Resident Visa, the visa allowing you to enter Canada.

Who needs a study permit?

As study permit is required if a prospective student wishes to engage in academic, professional, vocational, or other education or training that is more than six months in duration, in Canada.

 

 

Who is exempt from the requirement of a study permit:

Section 188(1) of the Immigration and Refugee Protection Regulations states the exemptions for the need of a study permit. Some exemptions include, but are not limited to and are not clarified in full:

  • If the student is a family member or a member of the private staff of a diplomat or an international organization of which Canada is a member;
  • If they are a member of the armed forces of a country that is a designated state for the purposes of the Visiting Forces Act;
  • If the duration of their course or program of studies is equal to or less than six months; and
  • If they are a registered Indian under the Indian Act.

The requirement for a study permit may not be required if the education is for, but not limited to, and with other certain restrictions:

  • Minor children already in Canada;
  • Courses of general interest or self-improvement;
  • Distance learning in the form of e-learning, correspondence, or internet courses; and
  • Refugees and protected persons
